General Terms and Conditions

The general terms and conditions of Along the Ridge may change. Only the latest version published on along-the-ridge.ch is valid.

In the event of any discrepancy between the French version of the General Terms and Conditions and another language version, the original French text shall prevail. The translation is provided for information purposes only and has no legal value. By accepting these terms and conditions, you automatically accept the original French text.

Field of application

Yorick Brunet (Along the Ridge) organises and leads hiking and snowshoe treks. These are referred to below as “tours”.

Registration / Conclusion of contract

The programme contains scheduled outings for which the participant (hereinafter referred to as the “participant”) may register. Registration can be made by e-mail or by means of a booking form.

After registration, the participant will receive written confirmation from Yorick Brunet (Along the Ridge) (hereinafter referred to as the “organiser”). From that moment, the registration is binding. These general terms and conditions therefore form an integral part of the contract between the participant and the organiser.

The organiser reserves the right to refuse a participant’s registration.

In the case of a private tour, the main participant registers the entire group. The term “participant” thus defines the group.

Conditions of participation

Good physical and mental health and appropriate equipment are required for all tours. By registering, the participant confirms that he/she meets the physical, mental and technical conditions required for the tour. If the participant does not meet these conditions, the organiser may decide to exclude him/her before the start of the tour or during the tour.

The participant must comply with the organiser’s instructions, failing which the organiser has the right to exclude the participant before the start or during the ride.

In the event of exclusion for the above-mentioned reasons, no reimbursement will be made.

Equipment

A list of specific equipment for each hike is provided to the participant before the start of the hike. A participant who is inadequately equipped may be refused in accordance with the section entitled “Cancellation by the participant”.

The organiser reserves the right to check the participant’s equipment and the contents of their bag in order to ensure the smooth running of the walk and the safety of the participant and the group.

Groups

Taking part in group tours requires tolerance, adaptability and an understanding of different abilities within the framework of the requirements of a tour. The organiser reserves the right to exclude from the tour participants who are unable to fit into the group, without entitlement to a refund.

Services

The services included in the price vary according to the offer. Details can be found in the tour description. Any service not explicitly included is excluded.

The journey to the meeting point and from the end of the tour to the participant’s home are made individually. All transport costs are the responsibility of the participant, unless otherwise stated in the tour description.

Programme changes

As a general rule, tours take place in all weathers. Weather conditions or the condition of the participants may lead to changes in the programme, area or itinerary at short notice. The participant accepts any changes made by the organiser in this respect. All additional travel and accommodation costs will be borne by the participant.

The decision to change the programme will be communicated to the participant as soon as possible by the means of communication used with the participant (e.g. telephone, SMS, messaging applications, e-mail).

Terms and conditions of payment

Upon receipt of the registration confirmation, payment is due according to the details on the invoice.

If payment is not received on time, the organiser may cancel the contract and charge cancellation fees in accordance with the section “Cancellation by the participant”.

The following methods of payment are accepted:

  • Bank transfer,
  • Twint (on telephone number).
Prices

Prices are quoted in Swiss francs and include all taxes.

The organiser reserves the right to pass on any fluctuations in the prices of commissioned service providers (e.g. huts, inns, transport services, local service providers) or third parties (e.g. exchange rates, VAT) in the event of a significant change between the publication of the tour offer and its execution.

Cancellation by the participant

If a participant is absent or prematurely withdraws from a tour, or if the organiser has to exclude the participant for medical or technical reasons, the participant is not entitled to a refund.

If the participant cancels the booking before the start of the tour, the following costs will be added to the CHF 50 processing fee:

  • 30 to 21 days before the start: 30% of the invoice amount.
  • 20 to 11 days before the start of the tour: 50% of the invoice amount.
  • 10 to 0 days before the start date: 100% of the invoice amount.

For privatised tours, the fees listed below are in addition to the CHF 50 processing fee:

  • up to 31 days before the start date: 50% of the invoice amount
  • 30 days or less before the start date: 100% of the invoice amount

Subject to other conditions specific to the activity chosen. In this case, the participant will be informed at the time of registration.

Cancellation by the organiser

Each tour has a minimum number of participants. If the minimum number of participants is not reached, the organiser may cancel the tour. The participant will be reimbursed in full, without being entitled to claim any compensation. Alternatively, the organiser may offer the participant an increase in the price.

In exceptional circumstances (e.g. severe avalanche danger, bad weather, illness, etc.), the organiser may cancel the tours at short notice. Amounts already paid will be refunded. The reimbursement of third-party services will depend on the cancellation clauses of the third party. All other claims are excluded. In the event of premature cancellation of the trip due to force majeure, there is no right to reimbursement.

Insurance

It is recommended that participants take out insurance cover for illness, accident, air rescue and cancellation. These insurances are at the participant’s expense. Membership of the REGA or other reciprocal organisation is strongly recommended.

The organiser reserves the right to call for assistance at the expense of the injured or ill participant, regardless of insurance cover.

The organiser has taken out professional liability insurance to the value of CHF 10,000,000 per damaging event and per year in accordance with the Federal High-Risk Activities Ordinance (Art. 24).

Responsibility

The qualified organiser offers participants the greatest possible safety. However, the particular dangers of the outdoors and the mountains mean that a residual risk cannot be ruled out. By registering, the participant expressly acknowledges these risks. The organiser’s liability is excluded in the event of slight negligence, fault on the part of the participants, fault on the part of third parties and force majeure.

The organiser is not liable for the theft, loss or damage of the participant’s equipment or rented equipment.

The participant remains solely responsible for all measures and precautions to be taken in the event of medical treatment, a specific diet or allergies requiring special monitoring.

Data protection

The organiser uses participants’ data to process registrations and to send out its own newsletter. The data will not be passed on to third parties, with the exception of

  • information requested for reservations related to the tour,
  • contact details so that COMEX, the Federal Certificate Examination Commission, can carry out the necessary checks when Yorick Brunet registers for the Federal Certificate.

The organiser reserves the right to take and publish photographs or videos including participants who are difficult to identify.

Pets

By default, pets are not allowed.

The entire content of the website along-the-ridge.ch, newsletter and documents sent to participants is legally protected by copyright. All rights are held by Yorick Brunet (Along the Ridge) or third parties. The elements of the website along-the-ridge.ch are accessible to the public for browsing purposes only. Any reproduction, transmission, modification, linking or use of the website along-the-ridge.ch for public or commercial purposes is prohibited without the prior written consent of Yorick Brunet.

Yorick Brunet reserves all rights to the entire content of the website along-the-ridge.ch, newsletter and documents sent to participants, with the exception of rights held by third parties.

Applicable law and place of jurisdiction

The contractual relationship between the participant and the organiser is subject to Swiss law. The place of jurisdiction is Berne.
